1. Scope and Seller Information

These Terms of Sale govern all purchases made through the Rose Paris online store at myroseparis.com. By placing an order, you agree to these Terms of Sale in their entirety.

2. Products

All products sold through myroseparis.com are pH-reactive lipsticks and related cosmetic products intended for personal use only.

Product images and descriptions are provided for informational purposes only. Colors and appearance may vary depending on your screen settings and device calibration. Images are not contractually binding.

We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice.

3. Order Acceptance

Placing an order on myroseparis.com constitutes an offer to purchase. Your order is not accepted until you receive a separate order confirmation email from Rose Paris. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of pricing errors, suspected fraud, or product unavailability.

If we cancel your order after payment has been processed, you will receive a full refund within 5 to 7 business days to your original payment method.

4. Pricing and Taxes

All prices are listed in US Dollars (USD). Applicable state and local sales taxes will be calculated and displayed at checkout based on your shipping address.

Prices are subject to change at any time without notice. The price charged for your order is the price in effect at the time your order is placed, as reflected in your order confirmation.

Promotional pricing and discount codes are valid for a limited time only and may not be combined with other offers unless expressly stated.

5. Payment

Payment is due in full at the time of checkout. We accept the following payment methods:

By providing your payment information, you represent and warrant that you are authorized to use the payment method provided and that the billing information you submit is accurate and complete.

In the event of a chargeback or payment dispute, we reserve the right to suspend or terminate your account and recover any amounts owed, including costs and fees incurred in connection with the dispute.

6. Availability and Fulfillment

All products are sold subject to availability. If a product becomes unavailable after your order is placed, we will notify you promptly and issue a full refund within 5 to 7 business days.

We currently ship to all 50 US states. Processing times and estimated delivery timeframes are outlined in our Shipping Policy.

7. Title and Risk of Loss

Title and risk of loss for all products pass to you upon delivery to the carrier. Once your package has been handed to the carrier, Rose Paris is not responsible for loss, theft, or damage in transit, except as outlined in our Shipping Policy.

8. Returns and Refunds

All returns and refunds are handled in accordance with our Refund and Return Policy, available at myroseparis.com/policies/refund-policy. We offer a 30-day satisfaction guarantee on all purchases.

9. Limited Warranty

Rose Paris warrants that all products sold are free from manufacturing defects at the time of delivery. This limited warranty does not cover damage caused by misuse, accident, unauthorized modification, or normal wear and tear.

If you receive a defective product, please contact us within 48 hours of delivery at contact@myroseparis.com. We will either replace the product or issue a full refund at our discretion.

THIS LIMITED WARRANTY IS THE ONLY WARRANTY WE PROVIDE. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROSE PARIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF A SALE SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT IN QUESTION.

SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

11. Governing Law

These Terms of Sale shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to a purchase shall be subject to the dispute resolution process outlined in our Terms of Service.

12. Changes to These Terms

We reserve the right to update these Terms of Sale at any time. The most current version will always be available on this page. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.
